General Terms and Conditions
The UMAKOV Online Store, operating at www.umakov.pl, is run by UMAKOV Polska Sp. z o.o., with its registered office in Ruda Śląska, Aleja Rodziny Gürtlerów 81, entered by the District Court in Gliwice, 10th Commercial Division of the National Court Register under KRS number 0000406652. VAT ID (NIP): PL6482779917. REGON number: 365906031.
1. The Online Store sells products via the Internet.
2. Orders are accepted online. To place an order, the order form must be completed. After submitting an order, the Buyer receives an email confirming receipt of the order by the store.
3. The order is processed once the store receives from the Buyer an email confirming the order submission.
4. The order fulfillment time is as follows:
* For cash on delivery payments: the second business day after receipt of order confirmation.
* For bank transfer payments (prepayment): the second business day after the funds have been credited to the store’s account.
5. Once the order is assembled, the goods are dispatched to the Buyer. Estimated delivery time: 1 business day.
6. The expected date of receipt of the shipment = fulfillment time + estimated delivery time.
7. If some items in the order are unavailable, the Buyer is informed immediately. The Buyer then decides whether the order should be partially fulfilled or canceled in its entirety.
8. Promotional sales and clearance sales apply to a limited quantity of goods. Orders are fulfilled in the order in which confirmed orders are received, until stocks of items offered in such sales are exhausted.
9. All prices are quoted in Polish zloty (PLN). The price listed for each item is binding at the moment the customer places the order. The store reserves the right to change product prices, introduce new products to the online store’s offer, run and cancel promotional campaigns on the store’s pages, or modify them.
10. Payment for ordered goods may be made by the Buyer using one of the following methods:
* Cash on delivery via courier: the courier collects payment.
* Through the COMGATE payment gateway.
* Bank transfer to the company’s account.
11. Ordered goods are shipped within Poland via the FEDEX courier service.
12. At the moment the Buyer confirms the order submitted by them, a contract is concluded between the SELLER and the BUYER. The subject of the contract is the goods specified in the order. The rights and obligations of the parties arising from the concluded contract are governed by the Polish Civil Code of 23 April 1964 (Journal of Laws of 1964 No. 16, item 93, as amended) and by the Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product (Journal of Laws of 2000 No. 22, item 271, as amended).
13. The sales contract is concluded in accordance with Polish law and in the Polish language.
14. The competent court for resolving disputes arising from the sales contract is either the court having jurisdiction over the defendant’s registered office or the court having jurisdiction over the place of performance of the contract.
15. We inform you that the personal data provided on the order form in the “Store Name” online store are collected and processed in accordance with the Act of 29 August 1997 on the protection of personal data (Journal of Laws of 2002 No. 101, item 926, as amended). Collected personal data are used solely for the purpose of fulfilling placed orders and informing about promotions, and under no circumstances will they be made available to third parties. Every customer of our store has the right to access, modify, and delete their personal data from our database.

16. Return of Goods.
In accordance with the Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product, the customer may withdraw from a purchase made in our store without giving a reason within 14 days from the date of receipt of the shipment.
To withdraw from the purchase contract, the Buyer may use the online form provided by the Seller on the Withdrawal from the Contract page. After the required details have been completed, the withdrawal from the purchase contract will be sent via the online interface. The Seller shall promptly confirm receipt of the form to the Buyer.
This is possible only if the goods show no signs of use, are complete, and have not been damaged in any way. Returned goods must be sent back along with the invoice received with them. The store guarantees a refund equal to the price of the goods. The money will be refunded within 14 business days by bank transfer to the account indicated by the customer or by postal transfer to the address specified in the order. The cost of returning the goods is non-refundable.
TECHNICAL SPECIFICATIONS AND GLASS TOLERANCES
1. GENERAL PROVISIONS ON STANDARDS
1.1. All supplied glass elements are manufactured in accordance with the applicable European EN standards and Polish technical standards PN, unless otherwise specified in the order, price quotation, technical documentation or written agreement between the parties.
1.2. Deviations that fall within the permissible tolerances under the applicable technical standards, manufacturer technical data sheets or the tolerances stated in these General Terms and Conditions shall not be considered product defects.
1.3. For thermally toughened safety glass ESG, the standard PN-EN 12150-1+A1 shall apply in particular, or its currently valid wording or the standard that replaces it.
1.4. For laminated glass and laminated safety glass VSG, the PN-EN ISO 12543 series of standards shall apply in particular, including:
- PN-EN ISO 12543-5 concerning dimensions and edge finishing,
- PN-EN ISO 12543-6 concerning appearance and visual assessment,
or their currently valid wording or the standards that replace them.
1.5. In the case of laminated VSG glass made from panes of thermally toughened glass, heat-strengthened glass or otherwise processed glass, the tolerances of the relevant constituent glass panes shall also be taken into account.
2. GLASS THICKNESS TOLERANCE
2.1. The final thickness of a glass element consists of the nominal thickness of the glass panes used and the thickness of the interlayers used, in particular PVB, EVA or other laminating materials.
2.2. Permissible thickness deviations for basic float glass shall be assessed in accordance with the applicable standard PN-EN 572-2, or in accordance with the currently valid technical data sheet of the manufacturer of the glass used.
Indicative thickness tolerances for float glass:
- nominal thickness from 3 mm to 6 mm: permissible deviation +/- 0.2 mm,
- nominal thickness from 8 mm to 12 mm: permissible deviation +/- 0.3 mm,
- greater thicknesses shall be assessed in accordance with the applicable standard or the manufacturer technical data sheet.
2.3. In the case of laminated VSG glass, the total thickness tolerance is determined as the sum of the tolerances of the individual glass panes and the tolerance of the interlayers used.
2.4. For a laminating film or interlayer with a total thickness of up to 2 mm, an additional deviation of +/- 0.1 mm may apply. For an interlayer with a total thickness above 2 mm, an additional deviation of +/- 0.2 mm may apply, unless the interlayer manufacturer technical data sheet or the applicable standard provides otherwise.
3. DIMENSIONAL TOLERANCES OF THERMALLY TOUGHENED ESG GLASS
3.1. Permissible deviations of linear dimensions, i.e. length and width, and permissible differences in diagonals for thermally toughened safety glass ESG shall be assessed in accordance with PN-EN 12150-1+A1, or in accordance with its currently valid wording or the standard that replaces it.
3.2. Unless expressly agreed otherwise, the following manufacturing tolerances in particular shall be considered permissible:
Glass thickness up to and including 8 mm:
- longest dimension up to 2,000 mm: length tolerance +/- 2.0 mm, maximum difference in diagonals 4.0 mm,
- longest dimension above 2,000 mm up to and including 3,000 mm: length tolerance +/- 3.0 mm, maximum difference in diagonals 6.0 mm,
- longest dimension above 3,000 mm: length tolerance +/- 4.0 mm, maximum difference in diagonals 8.0 mm.
Glass thickness above 8 mm:
- longest dimension up to 2,000 mm: length tolerance +/- 3.0 mm, maximum difference in diagonals 6.0 mm,
- longest dimension above 2,000 mm up to and including 3,000 mm: length tolerance +/- 4.0 mm, maximum difference in diagonals 8.0 mm,
- longest dimension above 3,000 mm: length tolerance +/- 5.0 mm, maximum difference in diagonals 10.0 mm.
3.3. The difference in diagonals is assessed as the absolute difference between two measured diagonals of a rectangular glass element.
4. DIMENSIONAL TOLERANCES OF LAMINATED VSG GLASS
4.1. Permissible deviations of linear dimensions for laminated VSG glass shall be assessed in accordance with PN-EN ISO 12543-5, or in accordance with its currently valid wording or the standard that replaces it.
4.2. For VSG, the dimensional tolerance may vary depending on the total thickness of the composition and the thickness of the individual glass panes used. Unless expressly agreed otherwise, the following manufacturing tolerances in particular shall be considered permissible:
VSG with a total thickness up to and including 8 mm:
- dimension up to 2,000 mm: +3.0 mm / -2.0 mm,
- dimension above 2,000 mm up to and including 3,000 mm: +4.5 mm / -2.5 mm,
- dimension above 3,000 mm: +5.0 mm / -3.0 mm.
VSG with a total thickness above 8 mm, where the individual glass panes are less than 10 mm thick:
- dimension up to 2,000 mm: +3.5 mm / -2.0 mm,
- dimension above 2,000 mm up to and including 3,000 mm: +5.0 mm / -3.0 mm,
- dimension above 3,000 mm: +6.0 mm / -4.0 mm.
VSG with a total thickness above 8 mm, where at least one glass pane is 10 mm thick or thicker:
- dimension up to 2,000 mm: +5.0 mm / -3.5 mm,
- dimension above 2,000 mm up to and including 3,000 mm: +6.0 mm / -4.0 mm,
- dimension above 3,000 mm: +7.0 mm / -5.0 mm.
4.3. In the case of VSG made from ESG glass, heat-strengthened glass or other processed glass, the tolerances of the constituent panes in accordance with the relevant technical standards may also apply.
4.4. If VSG consists of several glass panes or panes of different thicknesses, the decisive tolerances shall be those under the applicable standard, the manufacturer technical data sheet and the specific product composition.
5. OVERHANG AND MUTUAL DISPLACEMENT OF PANES IN VSG
5.1. In laminated VSG glass, mutual displacement of the individual glass panes may occur. Such displacement, also referred to as pane overhang, is a phenomenon resulting from the production technology and, within the limits of permissible tolerances, shall not be considered a product defect.
5.2. Unless expressly agreed otherwise, the following maximum values of mutual pane displacement in particular shall be considered permissible:
- dimension up to 1,000 mm: max. 2.0 mm,
- dimension above 1,000 mm up to and including 2,000 mm: max. 3.0 mm,
- dimension above 2,000 mm up to and including 4,000 mm: max. 4.0 mm,
- dimension above 4,000 mm: max. 6.0 mm.
6. VISUAL INSPECTION OF GLASS UPON ACCEPTANCE
6.1. Visual assessment of glass shall be carried out in accordance with the applicable technical standards, in particular PN-EN ISO 12543-6 in the case of laminated VSG glass and in accordance with the applicable standards or technical rules valid for the given type of glass.
6.2. During visual inspection, the glass shall be assessed under normal conditions of use, in particular:
- from a distance of at least 2 metres,
- looking perpendicular or approximately perpendicular to the plane of the glass,
- in ordinary diffuse daylight,
- without direct sunlight,
- without artificial point illumination from the immediate vicinity,
- without the use of a magnifying glass, microscope or other optical magnifying devices.
6.3. Assessment of glass against direct sunlight, under sharp light reflections, using artificial point illumination or from an unreasonably short distance is not decisive for the assessment of a defect, unless the applicable standard or a written agreement provides otherwise.
Complaints Procedure
1. In the case of a defect in the Goods that can be remedied, the Buyer has the right to have it remedied free of charge, in a timely manner and properly. The Seller is obliged to remedy the defect without undue delay.
2. The Buyer has been informed that, in individual cases, the Seller does not supervise the installation of stainless-steel elements (interior and exterior). In view of the above, the Seller expressly recommends purchasing Goods with the following characteristics: AISI 304 for interior use / AISI 316 for exterior use.
3. The Buyer hereby also acknowledges that, for example, in the case of purchasing glass holders in which the glass is fixed in a manner other than from the bottom side, there are 2 possible ways of fixing the glass in the holder:
a) a cheaper version of fixing the glass exclusively by means of a holder with rubber inserts, without the need to drill into the glass,
b) a more expensive version of fixing the glass by means of a holder with rubber inserts and subsequently also with the need to use a safety pin, which requires drilling into the glass.
Version b) may ultimately be more expensive for buyers due to the fact that drilling into the glass will be required during installation, and therefore this will ultimately be the more expensive version. Due to the need for the buyer to purchase the safety pin itself, version b) is only partially more expensive compared with version a).
If the buyer purchases the cheaper version a), the buyer is fully aware that during installation or use the glass may slip out and may possibly be damaged. The Seller is not obliged to inform the buyer separately of the above. The Buyer acknowledges and agrees that the seller shall not be liable for any damage caused as a result of the glass slipping out.
4. Instead of remedying the defect, the Buyer may request replacement of the Goods or, if the defect concerns only part of the Goods, replacement of that part of the Goods, provided that this does not cause the Seller disproportionate costs in view of the price of the Goods or the nature of the defect.
5. Instead of remedying the defect, the Seller may always replace the defective Goods with new, defect-free Goods, provided that this does not cause significant inconvenience to the Buyer.
6. In the case of a defect in the Goods that cannot be remedied and that prevents the Goods from being properly used as defect-free goods, the Buyer has the right to replacement of the Goods or the right to withdraw from the Purchase Agreement. The Buyer has the same rights in the case of irremovable defects where, due to the recurrence of the defect after repair or due to a greater number of defects, the Buyer cannot properly use the Goods.
7. In the case of other irremovable defects, the Buyer has the right to an adequate reduction in the price of the Goods.
8. The Seller shall not be liable for any damage to or displacement of the glass infill after the installation of the Goods has been carried out.
9. If, after receiving the goods, the customer discovers physical defects, the customer must immediately inform the Seller of such defects. The same applies if the ordered goods do not correspond to the delivered goods.
10. The store does not accept any shipments returned cash on delivery. The costs associated with returning the complained-of goods shall be reimbursed by the store without undue delay after receipt of the shipment and assessment of the complaint.
11. The returned goods must be accompanied by the invoice and a description of the reason for the complaint.
12. All complaints are handled within 14 working days from the date of their receipt. Damaged goods will be replaced with new, fully functional goods, and if this is no longer possible, for example due to stock depletion, the store will refund the buyer the equivalent of the price of the goods or offer the buyer other goods available in the store to choose from.
